Sexual Violence Injunctions and Restraining Orders

Who may petition for the injunction:

The victim of sexual violence, or the parent or legal guardian of a minor child who is the victim of sexual violence, may seek an injunction to protect against sexual violence.

“Sexual violence” must have at least one incident of sexual battery; a lewd or lascivious act committed upon, or in the presence of, a person younger than 16; luring or enticing a child’s sexual performance; or any other forcible felony where a sexual act is committed or attempted.

The petitioner must have reported the incident to law enforcement and be cooperating in any criminal proceeding.
